Rental contract PDF Netherlands 2026: what to include
Downloading a rental contract PDF sounds simple, but many templates miss required elements. What must be in there, and which pitfalls do you avoid?
Every few weeks someone searches for "rental contract PDF Netherlands" because they are about to rent out a room tomorrow and think a template will do the trick. The problem: many high-ranking PDFs in Google are outdated, miss the new Affordable Rent Act (1 July 2024), or contain clauses that do not hold up in court. An invalid clause does not void the contract. It means the law fills in the gap, and that result is often more favorable to the tenant than the landlord expected.
Which rental contract fits your situation?
Not every contract is the same. Before searching for a PDF, know which form fits your rental setup.
- Lodger arrangement (hospitaregeling): you rent out a room in your own home where you also live. A 9-month probation period applies, after which the tenant gets full rent protection. This has its own template because of the probation clause.
- Non-self-contained accommodation (room): you rent a room in a building where you do not live yourself. The points system for non-self-contained accommodation (WWSO) determines the maximum rent.
- Self-contained accommodation: a complete dwelling or apartment. Here the Housing Valuation System (WWS) applies up to a points threshold.
- Temporary rental: maximum 2 years for self-contained, 5 years for non-self-contained. The phrase "temporary rental agreement" must explicitly appear at the top, otherwise it automatically becomes a permanent agreement with rent protection.
What must minimally be in there?
A rental contract is valid if the basic essentials are correct: who are the parties, what is being rented, for what price, for what period. The rules wrap around that core.
Parties
- Full name, address, date of birth (or Chamber of Commerce number for renting businesses) of landlord and tenant.
- For joint tenancy (two people on one contract): list both tenants with "jointly and severally liable", otherwise the landlord cannot later recover the full rent from one person.
The premises
- Exact address description including floor, room number or house number.
- For room rental: square meters of the private room and which common spaces are shared (kitchen, bathroom, garden, storage).
- Any furniture or appliances you rent out with the room. Otherwise, who owns them later?
Rent and service charges
- Bare rent in figures and letters, splitting any service charges (gas, water, electricity, internet, cleaning of common spaces).
- Payment date (usually before the first of the month) and payment method (IBAN).
- Deposit as a separate amount (maximum 2 months bare rent since 1 July 2023).
Rent increases
- How and when rent may be increased. In 2026, a regulated contract may rise by at most the statutory percentage (linked to inflation + 1%, capped).
- The Affordable Rent Act requires the landlord to clarify at start which rent is based on the points system.
Termination
- Tenant notice period: at least 1 month, at most equal to the payment term.
- Landlord notice period: 3 months for non-self-contained, increasing with rental duration.
- Termination grounds: only for the specific reasons listed by law (urgent personal use, bad tenant, refusal of new reasonable offer, or under lodger rules: after 9 months without reason during probation).
Where to get a reliable PDF
Three sources we trust:
- The Huurcommissie: has a model rental contract for non-self-contained accommodation that is legally up to date.
- The Dutch Government (Rijksoverheid): refers landlords to standard ROZ models on its official site.
- Member organizations (VvE Belang and Vereniging Eigen Huis): provide standard contracts to members, often for a small fee or free.
What we do NOT recommend: random PDFs from sites you have never seen, or the first five "free rental contract" results in Google. Half miss the Affordable Rent Act (July 2024), the other half contain clauses the Huurcommissie strikes out immediately.
What we build ourselves: a lodger contract

Frequently asked questions
Can I write a rental contract myself in Word?
Yes, a Dutch rental contract is in principle form-free. A handwritten or self-typed contract is equally valid as a notary PDF, provided the essentials (parties, premises, rent, term) are present. Still, include all the required elements we list above, otherwise the law fills in the gaps.
Can I add clauses stricter than the law?
No, not to the tenant's detriment. The tenant can always invoke statutory protection, even when something else is written in the contract. A clause saying "the tenant may be terminated by the landlord at any moment" is not valid.
Must the contract be signed by both parties?
Not strictly required for validity, but strongly recommended for evidence. A digitally signed contract via DocuSign or a handwritten signature on a printed PDF are both legally valid.
What about a verbal agreement without a PDF?
A verbal rental agreement is valid under Dutch law (article 7:201 BW), but if a dispute arises, you must prove what was agreed. The party without evidence often loses. Always document in writing, even with friends or family.
Does the Affordable Rent Act also apply to my old 2022 PDF?
Not automatically. Contracts entered before 1 July 2024 often continue under the old rules. The tenant can still invoke the new points thresholds at renewal or rent increase. For new contracts in 2026 you must follow the new law.
Can I amend an existing contract with a PDF annex?
Yes, that is called an addendum. Both sign, add a date, and store it next to the main contract. For major changes (rent increase above statutory percentage, changing termination clauses) a new contract is better than an annex.
