Dutch lodger rules Rotterdam: hospitaregeling explained

Renting out or renting a lodger room in Rotterdam? How the Dutch hospitaregeling works, the nine-month rule, the rent cap for rooms and local rules.

The Dutch lodger arrangement is a national exception in the Civil Code: a tenant who rents a room in the home where the landlord lives receives less tenant protection than a regular tenant, at least during the first nine months. After those nine months, it becomes harder for the landlord to end the tenancy.

That is the national half of the story. The other half is the municipality. On top of the national Good Landlord Act (Wet goed verhuurderschap), municipalities can set their own rules, for example on landlord registration and permits. Rotterdam has its own approach, which can differ from Amsterdam or Utrecht.

How does the national lodger rule work?

The principle is simple. If you live in a home in Rotterdam yourself, and rent out a room in that same home to a tenant, the tenant has limited rent protection for the first nine months.

In concrete terms:

  • During the first nine months, the lodger landlord can end the tenancy relatively easily. The landlord still has to observe the notice period from the contract and the law.
  • After nine months, ending the tenancy becomes harder for the landlord. If the tenant does not agree, the landlord has to go to court.
  • The rent is capped by the points system for rooms from day one, both during and after the first nine months.

The lodger rule only applies if the landlord actually lives in the home (main residence) and rents out a room in that same home. Renting out a room in a home where you do not live yourself? Then the lodger rule does not apply. Renting out several rooms to different people? Then you may need a permit from the municipality, so check this before you start.

What makes Rotterdam different from Amsterdam or Utrecht?

Three things to check if you want to become a lodger landlord in Rotterdam.

One: landlord registration or permit. Under the Good Landlord Act, municipalities can require landlords to register or to hold a rental permit, sometimes only in certain areas. Check on rotterdam.nl whether this applies to your address, also if you rent out only one room. Ignoring local rules can lead to a fine.

Two: permit areas. In Rotterdam, rules for renting out a home room by room apply in designated areas. The list of areas can change, so check the current situation on rotterdam.nl. Whether you need a permit usually depends on how many rooms you rent out and to how many people.

Three: enforcement. Like other big cities, Rotterdam enforces the rules on room rental, especially where homes are rented out room by room without the right permit. For a classic lodger setup with one tenant who is properly registered at the address, the risk is lower.

What must you arrange as a lodger landlord in Rotterdam?

A short checklist for starting as a lodger landlord in Rotterdam.

  1. Tenant registration with the municipality. The tenant must register at your address (BRP) promptly after moving in, at the counter or digitally via DigiD. Skipping this is a violation of the Personal Records Database Act (Wet BRP).
  2. Landlord registration or permit, if required. Check rotterdam.nl before the tenant moves in.
  3. Written rental contract. A written contract is strongly recommended. Verbal agreements are not illegal, but you have no evidence in a dispute. Use a lodger contract that explicitly mentions the lodger arrangement.
  4. Income tax. In 2026, rental income from a room in your own home up to €6,633 per year can be tax-free under the room rental exemption (kamerverhuurvrijstelling). Above that you report it in box 1 as income from other activities. Our article on the Dutch room rental tax exemption explains the conditions.
  5. Bank and insurance. Check with your mortgage provider whether you need written consent, and notify your building and contents insurer.

What is the same in Rotterdam, Amsterdam and Utrecht?

For a classic lodger setup (a landlord who lives in the home plus one tenant), the national rules are the same in all three cities:

  • Rent protection: limited during the first nine months, after that ending the tenancy becomes harder.
  • Maximum rent: set by the points system for rooms. A room is always regulated, and the WOZ value does not count for rooms.
  • Room rental exemption 2026: €6,633 per year, a national tax rule.
  • Tenant registration: the tenant registers at the address with the municipality.

What differs per city are the local rules on landlord registration, permits and enforcement. Always check the website of your own municipality.

What are the rent prices in Rotterdam?

As a rough indication, asking prices for a furnished lodger room of 12 to 16 m² in Rotterdam often lie somewhere between €475 and €625 per month, depending on the neighbourhood. Central areas and the neighbourhoods around the university tend to be at the higher end. Rotterdam is generally cheaper than Amsterdam.

These are market indications, not legal maximums. The maximum rent of a room is always determined by the points system (woningwaarderingsstelsel), regardless of market price. Ask more than allowed? Your tenant can ask the Huurcommissie (rent tribunal) to test the starting rent within six months after the tenancy started, and you may have to pay back the difference. What if I want to rent as a lodger tenant in Rotterdam?

For room seekers: a few things to look out for. Always ask:

  1. Has the landlord arranged any registration or permit the municipality requires?
  2. Do I have a written contract that explicitly mentions the lodger arrangement?
  3. Will I be registered at the address with the municipality? Without registration you can run into problems with things like your BSN, benefits and post.
  4. How was the rent set? Ask for the points calculation or at least the floor area and shared facilities, so you can check it yourself.

What must be in the contract? The duration (fixed or indefinite), the rent, the lodger arrangement, notice periods and the deposit, if any. A good contract avoids a lot of arguments later. See what to include in a rental contract.

What are typical challenges in lodger relationships?

A few things that come up regularly:

Confusion about the Good Landlord Act. Many lodger landlords think the act does not apply to them because they only rent out one room. Wrong. No excessive deposit (max 2 months base rent) and no discriminatory selection apply to lodger landlords too.

Unexpectedly high service charges. Some lodger landlords charge a substantial amount per month on top of the rent for energy, internet and cleaning. That is allowed, provided it is reasonable and specified. Read our article on service charges for a rented room.

Tenant registration that does not happen. Some lodger landlords fear that registering the tenant makes it harder to end the tenancy. That is a misunderstanding: registration does not change the lodger rules. Not registering is illegal and may result in fines.

Frequently asked questions

Can a Rotterdam lodger landlord charge above the points system?

No. The points system (WWS) sets the maximum rent for any room, including lodger rooms. If the rent is too high, the tenant can ask the Huurcommissie to test the starting rent within six months after the tenancy started.

Do I need to register as a lodger landlord with the Chamber of Commerce?

Usually not for a single room in your own home. If you rent out several rooms as an activity, check with the Chamber of Commerce (KvK) whether registration is needed.

Can I evict the tenant in Rotterdam once the first nine months are over?

Not just like that. After nine months, ending the tenancy becomes harder for the landlord. If the tenant does not agree, the landlord has to go to court, which decides. That is fundamentally different from the first nine months.

What if my mortgage in Rotterdam does not allow rental?

Some mortgage conditions restrict renting out part of your home. Request written permission from your lender before you start, so you know where you stand.

Does the lodger arrangement also apply to anti-squat or temporary rentals?

No. The lodger arrangement requires the landlord to have their main residence in the home. Anti-squat and temporary rentals via intermediaries fall under different rules, often with less tenant protection.

How do I start as a lodger landlord in Rotterdam today?

Three steps. First: decide if you really want to and read up on the rules and your duties as a hospita. Second: post an advertisement and have a face-to-face conversation with candidates. Third: arrange any registration or permit, the contract and the tenant's municipal registration within the first week of move-in.
