Going away in summer and want to rent out your Amsterdam room? Understand the 2026 rules: landlord permission, the 30-night cap, fines and safer alternatives.

Every summer, thousands of students and young professionals in Amsterdam leave the city to go home or travel. And every summer, the same question comes up: can I rent out my room while I am away? For international tenants the answer is more restrictive than you might hope, especially in 2026.

Summer rental is not outright forbidden, but strict rules apply, and you need permission from more parties than you might expect. This article covers what is and is not allowed in Amsterdam in 2026, and what alternatives you have if you must be away for a few months.

Whose permission do I need for summer rental?

There are two parties whose permission you need before listing your room:

1. Your landlord (verhuurder) Your rental contract sets what you may do. Most Amsterdam rental contracts forbid subletting (onderhuur) or temporary rental without landlord permission. Do it anyway, and you risk contract termination. Always ask in writing.

If you live in a social-housing home from a housing association (woningcorporatie), subletting is almost always forbidden, regardless of the season. Housing associations actively enforce this and can terminate your contract on breach.

2. The municipality of Amsterdam Amsterdam has strict rules for holiday rental. Via platforms such as Airbnb you need a holiday-rental permit (vergunning vakantieverhuur). You may rent out your home a maximum of 30 nights per year via holiday-rental platforms. Exceed that limit and you risk a fine of up to 21,000 euro.

If you live in social housing, holiday rental is not allowed at all, no matter the permit situation.

What is the difference between subletting and holiday rental?

Subletting (onderhuur) is when you rent out your entire home while you do not live there yourself. This is the riskiest scenario: you lose your tenancy rights if it comes out without permission, and your landlord can take you to court.

Holiday rental (vakantieverhuur) is short-term rental via a platform to tourists. The municipal 30-night rule applies, plus the permit requirement. This is intended for owner-occupiers who occasionally rent out, not for permanent tenants.

Co-tenant (kamergenoot) is legally different: you rent out a room in your own home while you are also living there. In some cases this is allowed when your rental contract does not explicitly forbid it, but always ask your landlord. A co-tenant arrangement is typically more stable than a 30-night holiday rental.

What are the risks if I rent out without permission?

The risks are real:

  • Contract termination: Your landlord can take you to court to terminate the rental contract for breach.
  • Municipal fine: For illegal holiday rental the municipality can impose fines of up to 21,000 euro per offence.
  • Liability: If the subletter causes damage, you as the official tenant are liable toward your landlord. This includes water damage, theft from other tenants and noise complaints.
  • Visa or immigration impact: For non-EU tenants on a student visa, a court-confirmed breach of contract can affect your residency status in serious cases.

In Amsterdam there are active municipal enforcement officers (handhavers) who compare Airbnb listings with municipal registrations. If you rent anonymously via a platform, there is a real chance the municipality will trace it. Address photos in your listing often give away the location.

Yes, a few:

  • Trial absence (proefverlof): If you are away temporarily but plan to return (for example for an international internship), in some cases you can request a "trial-leave" arrangement from your housing association. This is a formal process where the association temporarily allows someone else to live in your home.
  • Hospita construction: If you live in a home that you can technically register as your own and rent out a room to a third party while you are there, this is a different legal structure than subletting. Discuss this with a legal adviser or the Juridisch Loket (Legal Aid Desk).
  • Diplomatic clause in some contracts: A few rental contracts include a clause allowing temporary subletting for documented work or study reasons. Read your contract carefully.

What are smart alternatives to summer rental?

If your home cannot be sublet legally, consider these alternatives:

  • Temporary contract transfer: Some landlords will agree to a temporary contract transfer to someone else while you are away. This requires formal landlord approval and notarial documentation in larger cases.
  • Find a permanent housemate: A regular housemate for a longer period is legally simpler than temporary rental. Our finding the right housemate guide covers how to find the right person.
  • Give up the room and research: If you are away for a full semester or longer, consider terminating the contract and searching again on return. Read our finding a student room in Amsterdam tips. In Amsterdam, returning rooms are often available again within 4 to 6 weeks of searching.
  • Couchsurfing for short trips: For 1- to 2-week trips, it is usually more practical to leave the room empty and continue paying than to risk subletting.

Frequently asked questions

Can I rent out my room via Airbnb as a tenant?

Only with permission from your landlord and a municipal holiday-rental permit in Amsterdam. Without permission this is contract breach and you risk losing your home. Internationals especially should not take this risk because of the additional immigration risk.

How do I ask permission from my landlord for temporary rental?

In writing, by email or registered letter. Describe the period, the temporary tenant, the price and the reason. Save the confirmation. If your landlord refuses, that decision is final under most rental contracts.

What if my landlord refuses and I do it anyway?

Then you risk losing your contract. In extreme cases the court can order eviction. This is a real risk, do not casually push through. For students on a tight rental market it can mean months of searching with no fallback.

Does the 30-nights cap apply to all Amsterdam homes?

Yes, all homes in Amsterdam have a maximum of 30 nights per year via holiday-rental platforms. This is enforced via platform data shared with the municipality.

Are there summer-rental rules outside Amsterdam?

Yes, most Dutch municipalities have comparable rules for holiday rental. Utrecht, Rotterdam and The Hague each have their own night-caps (usually between 30 and 60 nights). Consult your municipality's website or the Juridisch Loket for local rules.
